Minutes of Meeting on 1/12/2026

CALL TO ORDER: Mayor Markgraf called to order the regular meeting of Lakeside Park City Council at 7:00 P.M. on Monday, January 12, 2026, in the Lakeside Park City Building located at 9 Buttermilk Pike. Those in attendance were Mayor Markgraf, City Clerk Teresa Bruck and City Attorney Greg Voss. The council members present included Tom Bernheimer, Dennis Landwehr, George Best, Mary Ann Thaman, and Brian Waite. Absent from the meeting was Councilman Dave Wolfer.

AGENDA

With no changes or corrections to the Agenda, Ms. Thaman made the motion to adopt the agenda of January 12, 2026, as presented, and Mr. Bernheimer seconded the motion. Voice vote was taken.  5 Ayes, 0 Nays; motion carried.

MINUTES

With no corrections or changes, Mr. Waite made a motion to adopt the minutes of December 8, 2025, and Mr. Landwehr seconded the motion. Voice vote was taken. 5 Ayes, 0 Nays; motion carried.

With no corrections or changes to the Special Meeting of December 22, 2026, Ms. Thaman made a motion to adopt those minutes, and Mr. Bernheimer seconded the motion. Voice vote was taken. 5 Ayes, 0 Nays; motion carried.

CITIZENS ADDRESSING COUNCIL

Attorney Paul Darpel, spoke on behalf of Mr. and Mrs. Rizzo of 209 Applewood Drive, Lakeside Park. He advised council that he spoke to the zoning department regarding the text amendment changes discussed regarding pool fencing. He provided the council a copy of the Z21 section to be considered for change.

MAYORS REPORT:

The mayor asked Chief Degenhardt to introduce Sgt Joel Tignor, as the Chief did. The mayor advised that Sgt. Tignor helps our Public Works Director, Steve Greer, with the portable radar sign. Sgt. Tignor introduced himself to the council and provided a brief description of his career background, his family and stated he has a busy life.

Mayor introduced George Best as the newest council member and explained that Mr. Best formerly served on Kenton County Code Enforcement Board for many years, and his knowledge will be a great asset to the council.

The mayor spoke about the upcoming weather conditions and advised that if there is a snow emergency, the notifications are posted on our sign board and throughout our social media. But reminded residents to please remove their vehicles from the streets if there is a snow emergency called so the service trucks are clear to plow.

He stated the office will be closed on January 19th.

He expressed his condolences to Mr. Waite on the passing of his father.

The mayor announced our Recreation Director, Tracy Hart, is working on planning many events.

The mayor also advised that he would be reviewing committee assignments but noted that there will be two members from Lakeside Park on the Police Authority Board this year and Crestview Hills will have three. The mayor advised that he would remain on that board and so would Mr. Waite.

The mayor advised the council that he would like to schedule a goal planning session again this year before our budget time.

Last, he said something that was brought to his attention when council is voting and they wish to abstain, they must leave the room if they do not want their vote counted with the majority of the vote.

CITY ATTORNEY REPORT:

Mr. Voss conducted the reading of Municipal Order No. 01-2026 Authorizing application to KCPC to amend the current Lakeside Park Zoning Code and Zoning regarding pool fencing.

Ms. Thaman made a motion to adopt Municipal Order No. 01-2026, and Mr. Waite seconded the motion.

There were multiple discussions regarding creating zoning changes to accommodate one resident’s need, the difference between residential vs institutional use of a property, clarification that both parcels owned by the church are currently zoned residential, but the physical church property is listed as a non-conforming use, but the other church property as residence. It was explained that if the non-conforming use of that church ceased to exist, then the property would revert to residential use only. In addition, there were inquiries asking if a resident could change their residential at any time to be used as non-confirming and it was advised not without zoning changes. It was advised that all of Lakeside Park is zoned as residential and the exception for the church is that it was built before the zoning changes and is grandfathered as a non-conforming use. There were concerns raised about the amount of fence open, height of fence and the elevation of the playground in relationship to the pool. Mr. Darpel was only prepared to discuss the text amendment that evening.

Municipal Order #01-2026 was approved with a vote of 3 Ayes, 2 Nays and 0 Abstain.

Mr. Best made comment that he was not privileged to prior information on this issue, but he didn’t want to say yes, due to it being an attractive nuisance. If that concern was brought up in the early stages of putting in the pool, then Mr. Rizzo shouldn’t have had a pool. But because of the liability standpoint and from an understanding of both sides, his vote was yes.

CITY CLERK/TREASURER

Ms. Bruck reported only 9 delinquent property taxes; delinquent notices went out January 5th; the 4th quarter Insurance Premium taxes will be coming in; and she still has a few sidewalk payments that were not paid.

FIRE/EMS: 

Assistant Fire Chief Jansing reported 21 calls to Lakeside Park and advised that they are doing CPR instructor training.

PUBLIC WORKS:

Mr. Bernheimer provided project status updates on Crestview Hills Dixie Hwy Project plans submitted and minor changes being addressed before being scheduled in spring; Bellemonte Resurfacing still in planning stages; 5-year street plan still in development stages with Infrahub; Riegler Blacktop was awarded the 2025 Crack Seal Program for streets that are included are E Lakeside, Williams, Van Deren, Elizabeth, Holiday, Giesen and Paul Hesser; City Building Parking reseal has been completed; half the streets under the project have been completed and the rest will be done in the Spring; street sweeping completed; building received several security upgrades; timing system updated; radar sign moved to W Lakeside; Dixie Hwy sidewalk repairs are still waiting on response from the State; if snow emergency, please remove cars from street; traffic on Dixie Hwy has been an issue with the speculation of the timing of the lights and there is a study underway for this; due to many requests for leaf removal it is being researched to consider.

POLICE AUTHORITY:

The mayor advised the monthly activity report to show 30.77% of calls were for Lakeside Park; and he highlighted Ptl. Boyers’ completion of his final phase of training and is now patrolling; Tony Wilson is enrolled in DOCJT basic training; Ptl. Bush completed Red Dot Instructor Course; and Ptl. Armstrong is certified as EMT through St. Elizabeth and is on the National Registry.

PDS:

Mr. Waite said they did not meet last month. However, he commented about the subject of detached structures from last month’s meeting that he received information back from PDS, but he would like to discuss this further with other council members and will bring a recommendation on this subject later.

FINANCE:

Mr. Waite advised that Mr. Wolfer did the review this month, but he was providing the report in his absence. He reviewed all the bank and credit card statements. There was a significant increase in revenue due to the collection of taxes. Mr. Waite and Mr. Wolfer would like to meet prior to budget time to review the city’s financial investments.

MUNICIPAL GOVERNMENT LEAGUE OF NORTHERN KENTUCKY (MGLNK):

Mr. Landwehr had no report.

RECREATION:

Ms. Thaman reported Light Up Lakeside was a success, even though it had to be changed to another weekend. She thanked many people involved in helping with this event. She advised the County Senior Games to have begun with a very good turnout. The upcoming events include the Garden Club this Thursday, January 15, and Sunday Feb 1st Perfect North Slopes Tubing; Thursday Feb 26th will be a “Meet & Greet” with our new recreation director, Tracy Hart.

OLD BUSINESS

The mayor advised the city newsletter to continue to go out on either paper form for all or electronically for those who signed up.

NEW BUSINESS

Mr. Bernheimer said he shared an article with the other council members recently about the house bill that Steven Doan has filed regarding backyard chicken along with other parameters for the State to dictate what goes on in the cities. This generated concerns for him that this may take away the ability for cities to control what goes on in their individual cities and do away with city council positions.

Mr. Bernheimer made the motion to draft a formal Resolution regarding the opposition of House Bill filed by Steven Doan regarding chickens on residential property and send a copy to all Northern Kentucky representatives advising of the councils position. Mr. Landwehr seconded the motion. Under advisement from Mr. Voss, in order for a Resolution to be voted on, it must be read first. The mayor advised under the council’s direction, he will prepare the Resolution, and he will send to all of the Northern Kentucky Representatives to express the council’s concerns with this house bill.

Voice vote was taken to approve the mayor to draft the Resolution and speak to the House Representative. 5 Ayes, 0 Nays, 0 Abstain.
