										<content:encoded><![CDATA[<h1 style="text-align: center;">ORDINANCE 02-2025</h1>
<p>AN ORDINANCE OF THE CITY OF LAKESIDE PARK, IN KENTON COUNTY, KENTUCKY, AMENDING CHAPTER 51 OF THE CODE OF ORDINANCES, ENTITLED “ANIMAL</p>
<p>SERVICES,” TO AUTHORIZE RAISING CHICKENS.</p>
<p><strong><em>WHEREAS, </em></strong>there were no chicken ownership restrictions in Lakeside Park before 2015, and the current ordinance creates hardship for residents by disrupting established circumstances for those who owned chickens prior to the restrictions; and</p>
<p><strong><em>WHEREAS, </em></strong>residents of Lakeside Park have expressed a desire to raise pet chickens for recreational and mental health benefits, especially for families and individuals with special needs; and</p>
<p><strong><em>WHEREAS, </em></strong>the rising cost of eggs and other food staples has put significant financial strain on families, making self-sufficiency and local food production increasingly important for residents; and</p>
<p><strong><em>WHEREAS, </em></strong>requests from Lakeside Park residents have highlighted a desire to</p>
<p>legally own chickens, demonstrating the demand for such an opportunity within the community; and</p>
<p><strong><em>WHEREAS, </em></strong>an open records request seeking to inspect all complaints on chickens in Lakeside Park from January 2014 – March 2025 determined that no such&nbsp;records exist; and</p>
<p><strong>WHEREAS, </strong>section 50.009 of the city’s nuisance code includes policies addressing foul odors, specifically in subsections (L) and (O); and</p>
<p><strong><em>WHEREAS, </em></strong>section 50.009 of the city’s nuisance code covers feeding practices that may lead to unsanitary conditions in subsection (V); and</p>
<p><strong><em>WHEREAS, </em></strong>these updates provide appropriate legislation to ensure the protection of private property rights and the public health, safety and welfare of its residents, including but not limited to those residents who live next door or adjacent to&nbsp;residents with chickens.</p>
<p><strong><em>BE IT ORDAINED BY THE CITY OF LAKESIDE PARK, KENTUCKY:</em></strong></p>
<h3 style="text-align: center;">SECTION I</h3>
<p>That Chapter 51 “ANIMAL SERVICES” of the Lakeside Park, Kentucky Code of Ordinances shall be amended to include a new section numbered as Section 51.109, to read as follows:</p>
<h5>§ 51.109 CHICKENS</h5>
<ul>
<li><em>Raising chickens</em>
<ul>
<li>It shall be lawful to keep or raise chickens in the city for personal, family, or home use.</li>
<li>The chickens’ housing shall: be in a structure with a roof; be enclosed on all sides; have adequate ventilation; allow free movement for each bird; be able to be locked and secured to ensure chickens can not run at large or leave the housing and are safe from predators; be designed to be easily accessed, cleaned and maintained by the owners.</li>
<li>Stored feed must be kept in a rodent- and predator-proof</li>
<li>The housing shall be a minimum of twenty-five feet (25’) from the nearest residence, not including the residence of the owner of the chickens. For the purposes of this section, “residence” shall be defined to include both the principal structure and any decks, porches or sunrooms attached to the principal</li>
<li>It shall be unlawful for any person to raise a rooster in the</li>

</ul>
<h3 style="text-align: center;">SECTION II</h3>
<p>If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent</p>
<p>jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.</p>
<h3 style="text-align: center;">SECTION III</h3>
<p>This Ordinance shall take effect upon its passage and approval.</p>
<h3 style="text-align: center;">SECTION IV</h3>
<p>Publication of this Ordinance is hereby authorized to be by summary publication in accordance with Kentucky Law.</p>

<p><strong>AN ORDINANCE OF THE CITY OF LAKESIDE PARK, KENTUCKY AMENDING </strong></p>
<p><strong>CHAPTER 52, ARTICLE I OF THE LAKESIDE PARK, KENTUCKY CODE OF </strong></p>
<p><strong>ORDINANCES TO ADD LITTERING, AND ESTABLISHING PENALTIES FOR THE </strong></p>
<p><strong>VIOLATION THEREOF</strong>.</p>
<p><strong><em>WHEREAS</em></strong>, the City of Lakeside Park, Kentucky and its residents have been inundated with unsolicited litter; and</p>
<p><strong><em>WHEREAS</em></strong>, it is necessary to impose an anti-littering ordinance and provide for the penalties thereof;</p>
<p><strong><em>NOW, THEREFORE BE IT ORDAINED BY THE CITY OF LAKESIDE PARK, KENTUCKY, AS FOLLOWS:</em></strong></p>
<p><strong><em>&nbsp;</em></strong><strong><u>Section 52.005&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; CRIMINAL LITTERING</u></strong></p>
<p><em><u>(A) Definitions</u></em><u>. For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.</u></p>
<p>(1)&nbsp; &nbsp; &nbsp;<u>LITTERING – The offense of littering as defined by KRS 512.070</u></p>
<p>(2)&nbsp; &nbsp; &nbsp;<u>A person is guilty of criminal littering when he</u>:</p>
<p><u>(a)Drops or permits to drop on a highway or street any destructive or injurious material and does not immediately remove it; or</u></p>
<p><u>(b)Knowingly places or throws litter on any public or private property, including but not limited to unsolicited advertising flyers without permission; or</u></p>
<p><u>(c)Knowingly places or throws litter on any public or private water without permission; or</u></p>
<p><u>(d)Negligently places or throws glass or other dangerous pointed or edged substances on or adjacent to water to which the public has access for swimming or wading or on or within fifty feet of a public highway; or</u></p>
<p><u>(e)Discharges sewage, minerals, oil products or litter into public waters or lakes within the city.</u></p>
<p>(f)The unauthorized placement of any placards, signs posters or similar items attached to telephone poles, light poles, street signs, trees and fences.&nbsp;</p>
<p><strong>Section 52.999&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; PENALTY</strong></p>
<p><u>(D)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A violation of&nbsp; 52.005 of this chapter shall be a Class A misdemeanor for which any person convicted thereof in a court of competent jurisdiction shall be sentenced to pay a criminal fine not to exceed the maximum amount of $500, as set forth in KRS 534.040(2)(a), or a term of imprisonment not to exceed the maximum period of 12 months, as set forth in KRS 532.090(1), or both for a first offence; and to pay a criminal fine of not less than $250 but not to exceed $500 for a second or greater offence, and a term of imprisonment of not less than two days, but not to exceed the maximum period of 12 months, as set forth in KRS 532.090(1). Any corporation convicted of a violation of&nbsp;&nbsp;&nbsp; 52.005 of this chapter shall be fined not more than $10,000, as set forth in KRS 534.050(<strong>|</strong>)(b), for a first offence, and to pay a fine of at least $3,000, but not more than $10,000, for a second or greater offence.&nbsp; </u></p>

<p style="text-align: center;"><strong>AN ORDINANCE OF THE CITY OF LAKESIDE PARK, KENTUCKY AMENDING SECTION 41 OF THE LAKESIDE PARK CODE OF ORDINANCES, PERTAINING TO SIDEWALKS</strong></p>
<p><strong><em>WHEREAS</em></strong>, the City of Lakeside Park has determined that clarification is necessary in Section 41 of the Lakeside Park Code of Ordinances regarding sidewalk maintenance and repair; and</p>
<p><strong><em>WHEREAS</em></strong>, the City of Lakeside Park has a policy that if street reconstruction damages a sidewalk that the sidewalk will be repaired or replaced at no cost to the property owner; and</p>
<p><strong><em>WHEREAS</em></strong>, the City Council for the City of Lakeside Park has determined that it is not equitable or fair to the property owner to be required to be held liable for damages not caused by the property owner’s failure to maintain and keep in proper repair all portions of the property owner’s sidewalk.</p>
<p><strong><em>NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAKESIDE PARK, KENTUCKY AS FOLLOWS:</em></strong></p>
<p><strong><u>SECTION I </u></strong>Section 41.100 of the Lakeside Park Code of Ordinances shall be amended as follows:</p>
<ul>
<li><strong><em> 41.100 OWNER RESPONSIBLE FOR&nbsp;SIDEWALK&nbsp;REPAIR</em></strong></li>
</ul>
<p>&nbsp;&nbsp;&nbsp;Every person owning real estate in the city is responsible for maintaining and keeping in proper repair all portions of the&nbsp;sidewalk&nbsp;which parallel and/or abut the street, and/or lie within the street right- of-way immediately in front of, along side of, or in the rear of the person’s real estate.</p>
<p><u>&nbsp;&nbsp; Persons owning real estate in the city shall not be responsible for the cost of repairing or replacing the sidewalk or portions of a sidewalk damaged directly by street repair or reconstruction by the city or by other entities.&nbsp; The entity damaging or destroying such sidewalk or portion of sidewalk shall bear all responsibility for repair or replacement at the entity’s expense.</u></p>
<p><strong><u>SECTION II&nbsp; </u></strong>Section 41.106 of the Lakeside Park Code of Ordinances shall be amended as follows:</p>
<ul>
<li><strong><em> 41.106 INSPECTION OF WORK BY CITY</em></strong></li>
</ul>
<p><u>&nbsp;&nbsp;&nbsp;The Code Enforcement Officer or his or her duly authorized agent shall inspect the premises prior to and during any repairs or replacement to insure that the work is being performed in accord with the specifications adopted by the city, including compaction of the subbase and the insertion of pins or pins to connect the new sidewalk portion with the existing sidewalk.</u></p>
<p>If the Code Enforcement Officer or his or her duly authorized agent, upon completion of repairs, find the work is unsatisfactory, or has not been performed in accordance with city specifications, if any, the owner shall be required to replace or repair the work according to specifications supplied by the city.</p>
<p><strong><u>SECTION III &#8211; </u></strong>All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, if any, hereby repealed.</p>
<p><strong><u>SECTION IV &#8211; </u></strong>The provisions of this Ordinance are severable and the invalidity of any provision of this Ordinance shall not affect the validity of any other provisions hereof, and such other provisions shall remain in full force and effect as long as they remain valid in the absence of that provision determined to be invalid.</p>
<p><strong><u>SECTION V &#8211; </u></strong>This Ordinance shall be in full force and effect when passed, recorded, and published according to law.&nbsp; Said publication may be in summary form or by internet publication as allowed by law.</p>

<p style="text-align: center;"><strong>AN ORDINANCE OF THE CITY OF LAKESIDE PARK, KENTUCKY AMENDING THE LAKESIDE PARK ZONING ORDINANCE, ADOPTED AS ORDINANCE 01-2004, </strong><strong>REGARDING FENCING SURROUNDING SWIMMING POOLS ADJACENT TO INSTITUTIONAL USE PROPERTIES.</strong></p>
<p><strong><em>WHEREAS,</em></strong> a resident of the City of Lakeside Park, Kentucky requested the City to amend its zoning ordinances to permit less than fifty (50%) open fences adjacent to Institutional Use Properties when fencing is required to surround an in-ground swimming pool; and</p>
<p><strong><em>WHEREAS,</em></strong> the Lakeside Park City Council approved Municipal Order 1-2026 on January 12, 2026 agreeing to submit the proposed change the Planning and Development Services and the Kenton County Planning Commission for review and approval; and</p>
<p><strong><em>WHEREAS,</em></strong> the Kenton County Planning Commission held a public hearing on March 5, 2026, regarding the proposed Zoning Amendment and gave a favorable recommendation for approval by the City Council of Lakeside Park, Kentucky and requested that the City consider eliminating the requirement that adjacent property owners give written consent for such fencing;</p>
<p><strong><em>NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAKESIDE PARK, KENTUCKY AS FOLLOWS:</em></strong></p>
<p><strong><u>SECTION I</u></strong>&nbsp; The Lakeside Park Zoning Ordinance, adopted as Ordinance 02-2024, and all subsequent amendments related to Fences are hereby amended as follows and is hereby adopted.&nbsp; The amended provisions of Zoning Ordinance concerning fences for inground swimming pools adjacent to Institutional Use properties are attached hereto and incorporated by reference.</p>

<p style="text-align: center;"><strong>&nbsp;</strong><strong>AN ORDINANCE OF THE CITY OF LAKESIDE PARK, KENTUCKY AMENDING THE LAKESIDE PARK ZONING ORDINANCE, ADOPTED AS ORDINANCE 01-2004, </strong></p>
<p style="text-align: center;"><strong>REGARDING&nbsp;</strong><strong>MANUFACTURED HOMES AND RELATED ZONING ISSUES.</strong></p>
<p style="text-align: left;"><strong><em>WHEREAS,</em></strong> in its 2025 session, the Kentucky Legislature passed House Bill 160 to amend Kentucky Revised Statutes §100.348 to prevent local governmental entities from enforcing any zoning ordinances or provisions prohibiting or restricting manufactured homes within their jurisdictions subject to certain provisions; and</p>
<p><strong><em>WHEREAS,</em></strong> 2025 House Bill 160 was passed by the Kentucky Senate and signed into law by the Kentucky Governor to become effective on July 1, 2026; and</p>
<p><strong><em>WHEREAS,</em></strong> the Chair of the Kenton County Planning Commission submitted an application on behalf of the City of Lakeside Park, Kentucky regarding proposed text amendments related to Qualified Manufactured Homes, including definitions and updating the Lakeside Park Zoning Ordinance to conform to the mandates of the Kentucky House Bill 160 related to Manufactured Homes; and</p>
<p><strong><em>WHEREAS,</em></strong> following a public hearing on December 4, 2025, the Kenton County Planning Commission formally recommended specific text amendments to the Lakeside Park Zoning Ordinance;</p>
<p><strong><em>NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAKESIDE PARK, KENTUCKY AS FOLLOWS:</em></strong></p>
<p><strong><u>SECTION I </u></strong>&nbsp; The Lakeside Park Zoning Ordinance, adopted as Ordinance 02-2024, and all subsequent amendments related to Manufactured Homes are hereby amended as follows and is hereby adopted.&nbsp; The amended provisions of Zoning Ordinance concerning Manufactured Homes are attached hereto and incorporated by reference.</p>
<p><strong><u>SECTION II&nbsp; </u></strong>&nbsp;All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, if any, hereby repealed.</p>
<p><strong><u>SECTION III </u></strong>&nbsp;The provisions of this Ordinance are severable and the invalidity of any provision of this Ordinance shall not affect the validity of any other provisions hereof, and such other provisions shall remain in full force and effect as long as they remain valid in the absence of that provision determined to be invalid.</p>
<p><strong><u>SECTION IV&nbsp; </u></strong>&nbsp; This Ordinance shall be in full force and effect when passed, recorded, and published according to law.&nbsp; Said publication may be in summary form or by internet publication as allowed by law.</p>

<p style="text-align: center;"><strong>&nbsp;</strong><strong>AN ORDINANCE SETTING THE COMPENSATION FOR MAYOR<br />
FOR THE CITY OF LAKESIDE PARK, KENTUCKY</strong></p>
<p><strong><em>WHEREAS</em></strong>, pursuant to K.R.S. 83A.070 the Department of Local Government calculates the maximum allowable annual compensation for elected officials; and</p>
<p><strong><em>WHEREAS</em></strong>, that pursuant to K.R.S. 83A.075(1), the legislative body of each city shall fix the compensation of every elected city officer not later than the first Monday in May in the year the officer is elected; and</p>
<p><strong><em>WHEREAS,</em></strong> compensation for the Mayor for the City of Lakeside Park, Kentucky has remained the same since it was set in Ordinance 14-2010 dated July 12, 2010; and</p>
<p><strong><em>WHEREAS</em></strong>, pursuant to K.R.S. 83A.075(1) the compensation for the City Council for the City of Lakeside Park, Kentucky was increased under Ordinance 04-2024 and took take effect on January 1, 2025; and</p>
<p><strong><em>WHEREAS</em></strong>, under the Kentucky League of Cities 2024 Wage and Salary Survey, the median salary for a mayor of a municipality with a population between 1,000 and 2,999 residents was $12,099 and the median salary for a City Administrator was $74,745; and</p>
<p><strong><em>WHEREAS</em></strong>, the City of Lakeside Park is a small municipality of 2,850 residents and does not employ a City Administrator and the regulatory duties involving municipal work have increased significantly in the past fifteen (15) years; and</p>
<p><strong><em>WHEREAS</em></strong>, pursuant to K.R.S. 83A.075(1) the increase in compensation for the Mayor of the City of Lakeside Park Kentucky shall take effect on January 1, 2027.</p>
<p><strong><em>NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE LAKESIDE PARK CITY COUNCIL AS FOLLOWS:</em></strong></p>
<p><strong><u>SECTION I </u></strong>&nbsp; That the compensation for the Office of Mayor for the City of Lakeside Park, Kentucky shall be set at $14,000.00 yearly, beginning January 1, 2027.</p>
<p><strong><u>SECTION II&nbsp; </u></strong>&nbsp;That, in the event that City of Lakeside Park, Kentucky determines that the City should hire a City Administrator on a full or part-time basis after January 1, 2027, the compensation for the Office of Mayor for the City of Lakeside Park shall be reduced to $10,000.00 yearly effective on the hiring of a City Administrator.</p>
<p><strong><u>SECTION III&nbsp; </u></strong>&nbsp;The annual salaries of the Mayor may be increased, pursuant to the provisions K.R.S. 83A.075, based on the change in the consumer price index as determined by the Department of Local Government up to the amount of the cost-of-living increase granted by the City in the current budget for classified employees.</p>
<p><strong><u>SECTION IV&nbsp; </u></strong>&nbsp;The increases of all subsequent years shall be included in the annual budget approved by the City Council.</p>
